Residential purchase
Basis: Mexico's Federal Consumer Protection Act, its Regulations and NOM-247-SE-2021, section 4.8 and Appendix A.
AHO Realty Group informs the consumer that, in commercial transactions for the purchase and sale of residential property, they hold the following rights:
To receive, in respect of the properties offered, truthful, clear and up-to-date information and advertising, whatever the medium through which it is communicated, including digital media, so as to make the best purchase decision with an accurate understanding of the characteristics of the property being acquired, as provided for by the Federal Consumer Protection Act.
To be given information on the property's characteristics, including: land area, built area, type of structure, installations, finishes, fittings, parking space, common areas, available services and the property's general physical condition.
To freely choose the property that best meets their needs and fits their purchasing power.
Not to make any payment until the contractual relationship is set out in writing, except for deposits and operating expenses, on the terms provided for in the Federal Consumer Protection Act.
To sign a standard-form contract following the model registered with Mexico's Federal Consumer Protection Agency, setting out the terms and conditions of the property sale. After signing, the provider is obliged to give the consumer a copy of the signed contract.
To acquire a property that meets the safety and quality specifications set out in applicable regulations and reflected in the information and advertising received.
To receive the property within the timeframe and on the terms agreed with the provider in the relevant standard-form contract.
Where applicable, to exercise the warranties on real property provided for in the Federal Consumer Protection Act, subject to the specifications set out in the relevant standard-form contract.
To receive the corresponding rebate or compensation under the Federal Consumer Protection Act when, after the warranty has been invoked, defects or faults in the property persist. Likewise, to have the necessary repairs carried out where defects or faults are attributable to the provider, or to opt for replacement of the property or rescission of the contract where applicable.
To have free and accessible channels for enquiries, requests, claims and suggestions to the provider, and to know the address the provider has designated for receiving notices.
To receive protection from the competent authorities under applicable law, including the right to file complaints and claims with them.
To be provided with a Privacy Notice setting out how the personal data they supply will be processed and, where applicable, to consent to it; to have their personal data processed in accordance with applicable regulations; and to be informed of the mechanisms available to exercise their rights of Access, Rectification, Cancellation and Objection.
To be treated free from discrimination, without service or the sale of a home being denied or made conditional on grounds of gender, nationality, ethnic origin, sexual orientation, religion or any other characteristic, under applicable law.
To freely choose the notary public who will handle the deed.
This charter sets out minimum rights and does not replace the standard-form contract. NOM-247-SE-2021 applies to residential purchases; long-term tenancies are governed by Quintana Roo civil law and call for a different contractual analysis.
It is provided in print or electronically before or during the commercial relationship, and a record of receipt is kept.
